Introduction

Deloitte & Touche LLP has been appointed by courts in Ontario, Québec and British Columbia as the Claims Administrator of the Southwestern Resources Corp. (“SWR”) Class Action Settlement.

The Notice of Proposed Settlement (the “Notice”) is a court-approved summary of the Settlement. To review the Notice, click here.

Registering a Claim for Compensation

To receive compensation under the Settlement, each Class Member should submit a completed Claim Form and supporting documents (“Claim Package”) to the Administrator, on or before 5:00 pm Eastern time on June 1, 2009, using the secure Online Claim System.  Documentation of all SWR securities holdings on December 2, 2002, and documentation of all acquisitions and dispositions of SWR securities on or after December 3, 2002 though to the present time is required to substantiate each registered Claim.

You are a class member if you acquired securities of SWR during the period from December 3, 2002 to and including July 18, 2007, provided that if you acquired SWR securities in the period from December 3, 2002 to June 19, 2007, you held some or all of those securities at the close of trading on the TSX on June 19, 2007, and if you acquired SWR securities in the period from June 20 to July 18, 2007, you held some or all of those securities at the close of trading on the TSX on July 18, 2007, and you are not an Excluded Person.

Opting Out

The deadline to opt out of this class action has expired.

The Settlement

On November 3, 2008, Justice Brockenshire, of the Ontario Superior Court of Justice, certified the action as a class proceeding, approved the settlement and Ontario Class Counsel’s fees, disbursements and taxes. Justice Brockenshire delivered oral reasons for judgment. The issued and entered judgment may be viewed here.  

On November 14, 2008, the Quebec Superior Court approved the settlement, certified the action as a class proceeding and approved Quebec Class counsel's fees, disbursements and taxes. The issued and entered order may be viewed here.

On November 17, 2008, the British Columbia Supreme Court approved the settlement, certified the action as a class proceeding and approved British Columbia Class Counsel's fees, disbursements and taxes. The issued and entered order may be viewed here.
